Frequently Asked Questions

When is probate required in Queensland?

Probate is typically required when the deceased owned assets solely in their name (bank accounts, property, shares) and these institutions require proof of your authority as executor. Most QLD banks require probate for accounts over $50,000.

How long does probate take in Queensland?

From lodgment to grant, the Supreme Court of Queensland typically takes 4-8 weeks for straightforward applications. Our complete service (from initial consultation to grant) averages 8-10 weeks. We’ll keep you updated throughout the entire process.

What if there’s no will?

If the deceased didn’t leave a valid will, you’ll need Letters of Administration instead of probate. The process and cost are similar. Select “Letters of Administration” in the application form below, and we’ll guide you through the requirements.

Are there any hidden costs?

Absolutely not. Our $825 legal fee is fixed and includes all our professional services. The only additional costs are the Supreme Court filing fee ($819.90) and QLR advertising fee ($161.70) – these are mandatory government/statutory fees that apply regardless of which lawyer you use.

Why are you 47% cheaper than other Brisbane lawyers?

We are one of Queensland’s leading law firms when it comes to the number of probates we file each year. Our economies of scale allow us to keep costs low while maintaining quality. You get the same Supreme Court outcome at a fraction of the price.

Important: Beware of competitors advertising “$1,100 probate.” Their budget packages require YOU to lodge notices, file court documents, and handle court inquiries yourself. Their comparable full-service is actually $1,558.40 – ours is $825, truly all-inclusive.

I’m located interstate. Can you still help me apply for probate?

If your loved one was living anywhere in Queensland at the date of death, or had assets here, then we can assist regardless of where the executor is located. We have clients in NSW, New Zealand and across the world. The entire probate application process can be completed remotely.

What’s the difference between Grant of Probate and Letters of Administration?

Grant of Probate is needed when there’s a valid will. Letters of Administration is for estates without a valid will (intestacy). Both are processed by the Supreme Court QLD and our $825 fee applies to both. Learn more about Grant of Probate in Queensland.
